Family Sues Airbnb After 19-Month-Old Baby Dies From Opioid Overdose

 
A family has sued Airbnb after their baby died from an opioid overdose.
Lydie and Boris Lavenir are suing Airbnb after their 19-month-old daughter, Enora, died from a fentanyl overdose at a home they had rented through the site in Florida.
They had put their baby down for a nap after a lively morning with her four siblings at a lake house in August 2021.


According to the Washington Post, when Lydie walked into the room two hours later to wake her up, she found Enora’s face blue, with foam pouring out of her mouth.
The French family from the island of Guadeloupe in the Caribbean, immediately called the emergency services, but when they arrived, it was too late.

Similarly, no traces of fentanyl were found at the property and the toddler’s death has been deemed accidental.

“I am currently unable to determine how the child Enora Lavenir ingested the fentanyl,” an investigator wrote in the latest report.
Prior to receiving the autopsy results, the family did not consider the idea that drugs killed their daughter and thought it was something to do with the flight or that she died of sudden infant death syndrome.
The previous renters of the property admitted to throwing a party where there was cocaine present, but nothing that indicated those drugs killed Enora.
While police have not filed any criminal charges, the Lavenirs are suing Airbnb, the property owner, the rental manager and the previous renter who hosted the party.
The suit claims fentanyl was ingested at the party, and the home was never properly cleaned up, according to the Post.

The family’s lawyer, Thomas Scolaro, told the paper that his clients have come to the conclusion that partygoers brought the fentanyl.
Identifying who brought the drugs into the home, he said, is not his concern.
He said: “What I want to show is Airbnb provided no cleanup, no warning, no measure of safety for the family.”
Airbnb told The Post that its “hearts go out to the Lavenir family and their loved ones for their devastating loss.”
The renter meanwhile claimed he cannot be held responsible for what happened in the house after he left — including whether or not it was cleaned.
